1. Acceptance of Terms

By downloading, installing, or using Northe (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

2. Description of Service

Northe is a personal growth and wellness tracking application that provides:

• A short evening reflection: your mood, who you were with, what went well and what was hard
• One practice a day, chosen by AI from your reflection
• A skill ladder that grows with the practices you repeat
• A library of mental models and philosophical ideas
• A short profile of you, written by AI from your own reflections

The AI is central to the App and only processes what you write with your permission (see section 6.3).

3. User Eligibility

Age Requirement: You must be at least 13 years old to use this App. If you are under 18, you must have parental or guardian consent to use the App.

Capacity: By using the App, you represent that you have the legal capacity to enter into these Terms.

4. User Account and Data

4.1 No User Account Required

• The App does not require account creation
• All data is stored locally on your device
• You are responsible for maintaining the security of your device

4.2 Your Data Ownership

• You retain all rights to your personal data
• Your data belongs to you and is stored on your device
• We do not claim ownership of your journal entries, reflections, or personal information

4.3 Data Storage

• Data is stored locally using iOS file protection
• Optional iCloud sync uses your personal iCloud account
• You control whether data syncs to iCloud

5. Subscription and Payments

5.1 Subscription Tiers

The App offers:

• Free Trial: 14-day trial period with full access
• Monthly Subscription: Recurring monthly payment

5.2 Payment Terms

• Subscriptions are billed through the Apple App Store
• Payment is charged to your iTunes Account at confirmation of purchase
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period

5.3 Free Trial

• New users receive a 14-day free trial
• You can cancel anytime during the trial without charge
• If you don’t cancel before trial ends, you’ll be charged for the subscription

5.4 Cancellation and Refunds

• You can cancel your subscription anytime through App Store settings
• Cancellation takes effect at the end of the current billing period
• No refunds for partial subscription periods
• Refund requests are handled by Apple according to their policies

5.5 Price Changes

• We reserve the right to change subscription prices
• You will be notified of price changes in advance
• Continued use after price change constitutes acceptance

6. AI Services and External Integrations

6.1 AI Features

• The AI that writes your daily north and chooses your practice is part of the subscription; no setup or API key of your own is required
• Requests are routed through our proxy to third-party providers: OpenRouter and Groq. If one is unavailable the request falls back to the next
• API keys are managed by us, server-side, and are never stored on your device
• AI usage is rate-limited per device for fair access
• We are not responsible for the performance or availability of third-party AI services

6.2 AI Service Disclaimers

• AI-generated insights are for informational purposes only
• AI suggestions are not professional medical, psychological, or therapeutic advice
• Do not rely solely on AI recommendations for important life decisions
• AI responses may contain errors or inaccuracies

6.3 Data Sent to AI Services

• Only with your permission: nothing is sent to an AI service until you accept the App’s AI permission screen. You can withdraw it anytime in Settings › Privacy; without it, the App cannot pick your practice or write your daily north, and nothing is sent
• With permission, your evening reflection is sent through our AI proxy (a Cloudflare Worker, or our backup server in Germany when Cloudflare cannot be reached) to AI providers when you complete it, and your recent reflections and profile pages when you open the App on a new day
• Your email and Apple ID are never sent. Your name is sent only as part of your profile pages, as described in our Privacy Policy
• We do not store AI request content on our servers after processing

7. Acceptable Use Policy

7.1 Permitted Use

You may use the App for:

• Personal growth and self-improvement
• Mood and habit tracking
• Personal reflection and journaling
• Experimentation with behavioral changes

7.2 Prohibited Use

You may NOT:

• Use the App for illegal purposes
• Attempt to reverse engineer, decompile, or hack the App
• Share or resell your subscription access
• Use automated tools to extract data from the App
• Violate any applicable laws or regulations

8. Medical and Professional Disclaimer

8.1 Not Medical Advice

• The App is NOT a medical device
• Content provided is for informational and educational purposes only
• Do not use the App as a substitute for professional medical advice, diagnosis, or treatment
• Always seek the advice of qualified health professionals for medical conditions

8.2 Mental Health

• The App is not intended to diagnose, treat, or prevent any mental health condition
• If you are experiencing a mental health crisis, contact emergency services immediately

8.3 Wellbeing Data

• Mood and stress level are self-reported by you within the App
• The App does not read from Apple Health and requests no Health permissions

9. Intellectual Property Rights

9.1 App Ownership

• The App, including all content, features, and functionality, is owned by us
• App design, code, graphics, and text are protected by copyright and trademark laws
• You may not copy, modify, distribute, or create derivative works

9.2 User Content

• You retain all rights to your personal journal entries and reflections
• By using the App, you do not grant us any license to your personal content
• Your data is yours. It stays on your device, except your iCloud backup if you turn it on and what you allow the App to send for AI processing

9.3 Mental Models and Wisdom Content

• Mental model frameworks and philosophical quotes may be attributed to their original thinkers
• We do not claim ownership of public domain philosophical works
• Our unique implementation and presentation is copyrighted

10. Disclaimers and Limitations of Liability

10.1 “As Is” Basis

The App is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability of information

10.2 No Guarantee of Results

• We do not guarantee that using the App will lead to specific personal growth outcomes
• Results vary based on individual effort and circumstances
• Past patterns may not predict future outcomes

10.3 Technical Issues

We do not guarantee that the App will:

• Be error-free or uninterrupted
• Be free of viruses or harmful components
• Work with all devices or iOS versions
• Have accurate AI insights or recommendations

10.4 Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid for the subscription in the last 12 months
• We are not liable for data loss (you should backup your data regularly)

11. Indemnification

You agree to indemnify and hold harmless Northe, its developers, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your violation of applicable laws

12. Privacy and Data Protection

12.1 Privacy Policy

• Your privacy is governed by our Privacy Policy
• The Privacy Policy is incorporated into these Terms by reference
• By using the App, you consent to data practices described in our Privacy Policy

12.2 Data Processing

• We process data in accordance with GDPR and CCPA
• You have the right to access, delete, and export your data
• Data deletion and export tools are available in Settings

13. Modifications to Terms

13.1 Right to Modify

• We reserve the right to modify these Terms at any time
• We will notify you of significant changes through the App
• The “Last updated” date will be changed when Terms are modified

13.2 Your Acceptance

• Continued use after changes constitutes acceptance
• If you don’t agree with new Terms, stop using the App and cancel your subscription

14. Termination

14.1 Termination by You

• You may stop using the App at any time
• Cancel your subscription through the App Store
• Uninstall the App to remove all local data

14.2 Termination by Us

We may terminate or suspend your access if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• Required by law or regulatory authority

14.3 Effect of Termination

• Upon termination, your right to use the App ceases immediately
• Your subscription will not be refunded unless required by law
• Data stored locally on your device remains accessible until you delete it

15. Geographic Restrictions and Compliance

15.1 Availability

• The App is available worldwide through the Apple App Store
• Some features may not be available in all jurisdictions
• You are responsible for compliance with local laws

15.2 Export Controls

• You agree to comply with all export control laws
• You will not use the App in countries subject to US embargoes

16. Dispute Resolution

16.1 Governing Law

These Terms are governed by the laws of Spain, without regard to conflict of law principles.

16.2 Arbitration

• Disputes shall be resolved through binding arbitration
• Arbitration will be conducted by a mutually agreed arbitrator
• You waive the right to a jury trial or class action

16.3 Exceptions

You may bring claims in small claims court if they qualify.

17. General Provisions

17.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and us.

17.2 Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

17.3 Waiver

Failure to enforce any provision does not constitute a waiver of that provision.

17.4 Assignment

You may not assign these Terms. We may assign these Terms without your consent.

17.5 Language

If these Terms are translated, the English version prevails in case of conflict.
